Terms of Use and Membership Agreement

1. Parties and scope

This Terms of Use and Membership Agreement ("Agreement") is established electronically between FİNEST GLOBAL TEKNOLOJİ LTD. ŞTİ. ("Fibonacci Math", "Platform", "We"), which operates the website with the domain name fibonaccimath.com, subdomains, user panels, exam screens, and related digital services, and the student, parent/legal representative, mentor, teacher, or other user ("User") who registers on the Platform.

The Agreement regulates the basic terms of use for account creation, profile usage, mock exams, olympiad applications, result viewing, rankings, mentor-student relationships, support requests, payment links, and other services offered through the Platform.

2. Membership and account security

  • The User is obliged to provide accurate, up-to-date information belonging to themselves or the person they represent during registration.
  • The account is personal. The password, verification code, exam access information, or login links cannot be shared with third parties.
  • The User is obliged to notify without delay via the support request on the Platform (https://fibonaccimath.com/public/support.php) or at orhancevik@hotmail.com.tr if there is a suspicion of unauthorized access to their account.
  • For security purposes, the Platform may implement email verification, session checks, risk-based verification, or additional identity verification steps.
  • Opening an account on behalf of an individual can only be done by a parent/legal representative or a legally authorized person.

3. Child and student accounts

Since the Platform can be used by students, it applies age-based protection measures. If required by the User's age or the applicable law in their country, membership, olympiad application, payment, photo/video usage, or certain data processing activities may be subject to the approval of the parent/legal representative.

The parent/legal representative is responsible, to the extent of their authority, for the accuracy of applications made through the student account, entered profile information, and payment transactions.

4. Mentor accounts

A mentor account may be activated subject to approval by the Platform. A mentor may only access the performance, exam, and application information of students lawfully associated with them. The mentor cannot use, share, or process student data for purposes outside the Platform or for commercial purposes.

The Platform may suspend or terminate mentor privileges upon detecting false identities, unauthorized student additions, data misuse, or security risks.

5. Use of services

  • The User is obliged to use the Platform in compliance with the law, exam rules, and academic integrity principles.
  • Exam questions, solutions, visuals, software, databases, designs, and other content cannot be copied, reproduced, published, or used commercially unless permitted.
  • Bots, automation, scraping, security testing, reverse engineering, or unauthorized access attempts are prohibited, except for security tests with explicit written permission.
  • The User cannot impersonate other persons; they cannot submit false documents, incorrect age/grade information, or misleading application data.

6. Exams, scores, and results

The exam duration, number of questions, scoring, cutoff score, ranking, and objection procedure are specified in the relevant exam or olympiad announcement. In the event of a technical error, question cancellation, answer key correction, or measurement-evaluation necessity, the Platform may make the necessary corrections to the scoring method, provided that it applies equal and pre-disclosable criteria to all candidates.

7. Intellectual property

Intellectual and industrial property rights over the Platform trademarks, logos, question pools, texts, visual designs, exam formats, software codes, and databases belong to the rights holder. The User is granted only a personal and limited right of use; no transfer of ownership is made.

8. Service interruptions and technical requirements

The Platform may be temporarily inaccessible due to maintenance, security updates, third-party service interruptions, internet infrastructure, or force majeure. Planned interruptions are announced in advance as much as possible. The User is responsible for providing a working device, an up-to-date browser, and an adequate internet connection during online exams.

In widespread technical issues originating from the Platform that affect the integrity of the exam, corrective measures such as extending, reopening, or re-administering the exam may be explained in the relevant announcement.

9. Suspension and termination of account

The Platform may temporarily suspend the account in cases of security breaches, suspicion of fraud, cheating in exams, misuse of third-party data, payment fraud, or material breach of the Agreement. The User is provided with a justification and an appeal channel to the extent that it does not compromise security or the investigation.

The User may request the closure of their account. The closure of the account does not mean that payment, accounting, dispute, or exam security records that must be retained in accordance with legislation will be deleted immediately.

10. Limitation of liability

Without prejudice to liabilities that cannot be limited by law, the Platform cannot be held liable for indirect losses arising from third-party internet providers, device failures, user errors, or events beyond its control. The consumer's rights arising from mandatory legislation are reserved.

11. Amendments

Substantial changes are announced through appropriate methods before they enter into force. No retroactive and unfair changes detrimental to the user shall be made in existing consumer contracts. The date and version number of the new version are recorded.

12. Governing law and dispute resolution

Mandatory consumer provisions in the consumer's place of residence are reserved. Persons acting in the capacity of a consumer in Turkey may apply to Consumer Arbitration Committees or Consumer Courts depending on the nature of the dispute and the monetary limit. For commercial users, Turkish law shall apply; the Courts and Enforcement Offices of Gaziantep shall have jurisdiction over disputes.
